1. Introduction

ClassCover Pty Limited (referred to for the purposes of the below as “HomeTeacher”, “us”, “we”, “our”) provides this website (www.hometeacher.io), (“Website”) as a platform allowing students and teachers to book and conduct lessons online.

These terms and conditions (“Terms”) govern your use of the Website and any software incorporated in the Website. In using this website for these or any other purposes, you agree to be bound by these Terms. If you do not accept these Terms, you must refrain from using this Website.

These Terms, together with any operating rules, policies, pricing, or other documents expressly incorporated herein by reference and/or published from time to time by HomeTeacher on the Website (collectively, the “Agreement), constitute the entire agreement between HomeTeacher and you regarding our services delivered to you through the Website, and supersede all prior agreements between us regarding the subject matter of the Agreement.

If you are under 18 years of age, the agreement must be entered into by a parent or guardian. In that case, both you and your parent or legal guardian will need to ensure compliance with the Agreement. Following, “you” and “your” will then refer to both you and, where applicable, your parents/legal guardians.

Please read the Terms carefully before signing up for our services through the Website. You accept the Terms by confirming the sign up process in the ‘Final Step: Select Payment Options’ and clicking ‘Place order or by creating your profile via the Website.

By accepting these Terms, you warrant that that you are of legal age and capacity.

2. Services

We will provide you with the following services through the Website:

  1. Enable you to make bookings for online tutoring (”Lesson” or “Lessons”) with accredited teachers registered on the Website (“Teacher” or “Teachers”); and
  2. Provide an online platform for conducting such Lessons as one-on-one or group Lessons.

3. Fees & Payments

We will provide you with the following services through the Website:

  1. Enable you to make bookings for online tutoring (”Lesson” or “Lessons”) with accredited teachers registered on the Website (“Teacher” or “Teachers”); and
  2. Provide an online platform for conducting such Lessons as one-on-one or group Lessons.

4. Cancellations and refunds

Where you canceled any Lesson(s) booked within less than 24 hours prior to the time of the booking, you will not be entitled to any credit or refund.

Where you canceled any Lesson(s) booked upon more than 24 hours’ notice prior to the time of the booking, you will be provided with a credit note equal to the full amount of Fees paid by you for the cancelled Lesson.

Notwithstanding the foregoing, if you cancel a pre-paid bundle package of Lessons before you complete the committed number of Lessons, you will not be entitled to any credit or refund.

If a Teacher cancels a Lesson, we will try to provide you with another Teacher with similar qualifications and experience. If we are unable to provide a replacement Teacher at the scheduled Lesson time, we will try to provide you with an alternative Lesson at a time that is convenient for you.

5. Your Responsibilities

Without limiting your other obligations under these Terms, you agree:

  1. to provide true, accurate, current and complete information about yourself as prompted by the sign up form and to maintain and promptly update the profile to keep it true, accurate, current and complete;
  2. that you are required to attend each Lesson on the date and time that you have booked, unless you have complied with the notice period described in clause 3 of these Terms.
  3. that you are responsible for providing and maintaining all your computer equipment, including a camera and microphone, software and the latest version of the browser necessary for you to access the Website and Lessons. You are required to run a test on your computer in order ensure its functionality for the purposes of conducting a Lesson. If you detect any technical issues, you will need to refer to HomeTeacher’s support page www.hometeacher.io and contact our support team if required.
  4. to communicate with Teachers only though the Website;
  5. notify us promptly by e-mail to hello@HomeTeacher.io if you suspect unauthorised use of the Website via your profile. Until you notify us, you remain responsible for such unauthorised use;
  6. Not to share your login details and/or your use of the Website with anyone else. For the avoidance of doubt, parents or legal guardians of the student identified in the Website registration form can have access to the Website for the purposes of assisting such student in their use of the Website.

6. Intellectual Property Rights

  1. Unless otherwise stated, the material published on the Website is subject to Australian intellectual property laws and you agree to abide by all copyright notices and other restrictions contained in the Website and the Agreement. Access to, and use of, the Website is solely for personal, educational and non-commercial use and you must not modify, copy, reproduce, republish, or display any content from the Website and represent it as your own, upload to a third party, post, transmit or distribute this content in any way except as permitted by law or expressly provided for on the Website or expressly authorised in writing by us and, where relevant, any third party owner or rights holder.
  2. Nothing on the Website should be construed as granting any licence or right of use of any trade mark, service mark or logo displayed on the Website without the express written permission of the relevant owner or rights holder in relation to the mark or logo. All trademarks, service marks, and logos used on the Website are the trademarks, service marks and logos of their respective owners.

7. User Conduct

You agree to not use the Website to:

  1. upload, post, or otherwise transmit any content that is unsolicited, unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
  2. upload, post, or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  3. intentionally or unintentionally violate any applicable law.

8. Disclaimer or Warranties

You expressly acknowledge and agree that:

The Website and all associated services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, HomeTeacher expressly disclaims all warranties, conditions and other terms of any kind, whether express or implied, including, but not limited to any implied term of merchantability, satisfactory quality, fitness for a particular purpose, and any term as to the provision of services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right.

9. Limitation of Liability

Notwithstanding any other provision of the Terms or the Agreement and to the extent permitted by law, we shall not be liable (whether for breach of contract, under indemnity, negligence or on any other legal or equitable basis) for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, revenue, business, contract, goodwill, use, data or anticipated benefit or saving, any delay, financing costs or increase in operating costs or other intangible losses (even if HomeTeacher has been advised of the possibility of such damages), resulting from the use or inability to use the Website or otherwise in connection with the Agreement. Otherwise, our liability is limited (to the extent permitted by law) at our option to the following:

  1. to the supply of the services again; or
  2. to issue a refund.

10. Links to other sites

The Website may provide, or third parties may provide, links to other World Wide Web sites or resources. Because HomeTeacher has no control over such sites and resources, you acknowledge and agree that HomeTeacher is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, services, products, or other materials on or available from such sites or resources. You further acknowledge and agree that HomeTeacher shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

11. Privacy Policy

You agree that your personal information collected under or in connection with the Agreement will be dealt with in accordance with the terms of our privacy policy, the current version of which can be viewed at https://www.HomeTeacher.io/privacy-policy/.

12. General

We may modify these Terms and/or the Agreement at any time and may do so by posting notice of such modifications on the Website. Any modification is effective immediately upon posting the modification on the Website. Your use of the Website after the effective date of a change constitutes your continued acceptance of the Terms and the Agreement, as amended.

2.4 We may in our sole and absolute discretion, for any reason and without notice:

  1. alter or withdraw any functionality on the Website;
  2. withdraw or suspend your access to all or any part of the Website and your account;
  3. monitor your use of the Website;
  4. subject to any applicable laws, treat any material that you transmit or display as non-confidential and non-proprietary; and
  5. edit or remove any material that you have may have uploaded, posted, emailed or otherwise transmitted to the Website.

If any provision of these Terms is determined to be invalid, all other provisions remain in force.

These Terms will be governed by the laws of New South Wales, Australia and disputes relating to them will be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.
